“Bay Ledges” Presave Giveaway (the “Giveaway”)
PRIZES:
a. There are a total of four (4) prizes to be won, as follows:
Grand Prize (four winners) – Two (2) tickets to attend one (1) of Bay Ledges February Tour show dates in the market chosen by the entrant on the entry form.
b. The prize cannot be transferred, substituted or redeemed for cash. Bay Ledges and Nettwerk Music Group reserve the right to substitute the prize for a prize of equal or greater value should all or part of the prize become unavailable for any reason. Expenses not mentioned herein are the responsibility of the prize winners, including but not limited to travel costs to and from the show.f
HOW TO ENTER:
NO PURCHASE NECESSARY. PURCHASE DOES NOT ENHANCE CHANCE OF WINNING.
To enter the Giveaway, presave “Walk Away” by Bay Ledges at https://bayledgesmusic.ffm.to/walkaway. When prompted, file an official entry form via connect.nettwerk.com/bayledges (the “Giveaway Website”).
You may enter the Giveaway once. The chances of being selected as a winner of the Giveaway are dependent upon the total number of eligible entries received.
This Giveaway is open to all legal individual residents of Canada (excluding Quebec), the United States (excluding Rhode Island), the United Kingdom, Ireland, Germany, France, Spain, Australia, Japan and South Korea who are over the age of majority or older in their applicable jurisdiction of residence by the beginning of the Giveaway period (January 12, 2022), except employees of Bay Ledges and Nettwerk Music Group Inc. (collectively, the “Giveaway Sponsors”), their respective affiliates, agents, or assigns, the Giveaway suppliers (including, without limitation, Zoom) and organizers, the judges and members of their respective immediate families with whom they are domiciled.
The Giveaway Sponsors are not responsible for lost, interrupted or unavailable network server or telephone transmissions; technical failure, jumbles, scrambled or misdirected transmissions; late, lost, incomplete, delayed, or misdirected entries; or other error of any kind whether human, mechanical, or electronic.
The Giveaway winners’ names will be published once the Giveaway closes. By entering this Giveaway and accepting the prize, you are giving the Giveaway Sponsors, and each of their parents, subsidiaries, affiliates, agents and assigns permission to publish your name and likeness on their respective websites, social media outlets and marketing materials.
WINNER SELECTION:
a. On Tuesday, January 25, 2022, at 12pm (PST), Bay Ledges or Nettwerk Music Group will randomly draw an entry from all eligible entries received. To be eligible entries must be postmarked or electronically submitted no later than the Giveaway closing date of January 20, 2021, and announce the winners of the Giveaway (each a “Winner”).
b. The Winners will be notified via email within ten (10) business days and the selected entrant must respond within two (2) business days in order to be awarded the prize.
c. Neither the Giveaway Sponsors nor its parents, subsidiaries, affiliates, agents and assigns will be responsible for the failure for any reason whatsoever of the selected entrant not being able to receive notification, or the selected entrant not being able to respond, or for the Giveaway Sponsors not being able to receive the selected entrant’s response as prescribed above.
d. The Winners releases the Giveaway Sponsors, To, and each of their respective affiliates, including their parent and affiliated companies, directors, employees, officers, agents, and assigns including without limitation their advertising and promotion agencies, from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize. Before being declared a Winner and being awarded the prize, the selected entrant must sign Giveaway Sponsors’ declaration and release form to:
(a) accept the prize as awarded and confirm compliance with these Giveaway Rules;
(b) release the Giveaway Sponsors, the Giveaway suppliers (including, without limitation, Nettwerk Music Group) and Giveaway organizers, and each of their respective parent companies, subsidiaries, affiliates and/or related companies and each of their employees, directors, officers, suppliers, agents, sponsors, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Giveaway, participation in any Giveaway-related activity or the acceptance, use, or misuse of any prize;
(c) consent to the use, publish and broadcast the selected entrant’s name, address, photograph or likeness, and statements for any publicity purpose connected with this Giveaway and the Releasees, without any further compensation, other than the prize offered.
In the event that a potential Winner does not comply with all the provisions as contemplated in these Giveaway Rules, Giveaway Sponsors shall have the right to disqualify such potential Winner and an alternate potential Winner shall be selected and Giveaway Sponsors shall be fully and completely released and discharged from any liability or responsibility in this regard.
e. All decisions of Giveaway Sponsors with respect to any aspect of this Giveaway, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Giveaway.
f. If for any reason, in the opinion of Giveaway Sponsors, in its sole discretion, the Giveaway is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of technical failures or any other causes beyond its control, the Giveaway Sponsors reserve the right to cancel, terminate, modify, amend, extend or suspend the Giveaway, and to select Winners from previously received eligible entries in addition, the Giveaway Sponsors reserve the right to modify the Giveaway rules for any of the reasons above.
LIMITATION OF LIABILITY:
The Releasees are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error which may occur in the processing of entries in the Giveaway. Entrant further agrees that in any cause of action, the Releasees' liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the Releasees be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
By submitting an entry, you hereby release the Releasees of and from any and all claims, demands and liabilities of every kind whatsoever that may arise in relation to your entry and the material submitted in connection therewith, or by reason of any claim now or hereafter made by you that the Releasees have used or appropriated any material submitted as part of your Giveaway entry. The Giveaway is in no way sponsored, endorsed or administered by, or associated with, Facebook or Feature FM.
PRIVACY:
By participating in this Giveaway, entrant: (i) grants to Giveaway Sponsors, its agents and/or representatives the right to use the entrant’s name, date of birth, mailing address, telephone number, cell phone number and email address (“Personal Information”) for the purpose of administering the Giveaway, including but not limited to contacting and announcing the Winners thereof; (ii) grants to Giveaway Sponsors, its agents and/or representatives the right to use the entrant’s Personal Information for publicity and promotional purposes relating to the Giveaway, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledges that Giveaway Sponsors may disclose the entrant’s Personal Information to third-party agents and service providers of Giveaway Sponsors in connection with any of the activities listed in (i) and (ii) above. Personal Information includes information that could be used, alone or in combination, to identify an individual. Giveaway Sponsors will not sell or transmit this information to third parties except for the purposes of administering this Giveaway. Personal Information of entrant’s that Giveaway Sponsor collects may be transferred to and processed outside the United States of America, and will be subject to the laws of those jurisdictions, which may be different from U.S. laws. Any inquiry concerning the Personal Information held by the Giveaway Sponsor in connection with this Giveaway, including any request to access or correct the Personal Information should be addressed to info@nettwerk.com .
LAWS:
These are the official Rules. This Giveaway is subject to all applicable federal, state and municipal laws and regulations. These Giveaway Rules are subject to change without notice in order to comply with any applicable federal, state and municipal laws and regulations or the policies of any other entity having jurisdiction over the Giveaway or the Giveaway Sponsors.
THIS GIVEAWAY IS VOID WHERE PROHIBITED BY LAW.
